The Appendix to the Bitbon System Public Contract “Bitbon System Account” (hereinafter referred to as the “Appendix”) specifies operating terms and conditions of the Bitbon System account, as well as the procedure for its use by the Bitbon System User[i].

SECTION 1. GENERAL PROVISIONS
Chapter 1. Terms and Definitions
Article 1. Use of Terms
1. The terms used in this Appendix shall be interpreted in accordance with the definitions given in the Appendix to the Bitbon System Public Contract Terms and Definitions in the Bitbon System Social Network.
Chapter 2. Subject and Structure of the Appendix
Article 2. Subject of the Appendix
1. The subject of this Appendix is relations between Bitbon System Users[i] (hereinafter referred to as the “Users”) arising when they are using their Bitbon System accounts (hereinafter referred to as the “account”).
2. This Appendix establishes operating terms and conditions of the account, as well as the rules and the terms and conditions for using the functionalities of the account by the User.
Article 3. Structure of the Appendix
1. This Appendix consists of the preamble, sections, chapters, which consist of articles that include parts and paragraphs. The structure of the Appendix includes references and links to the Provisions of the Bitbon System Public Contract as well as to other Appendices, which are an integral part of the Bitbon System Public Contract.
SECTION 2. OPERATIVE PROVISIONS
Chapter 3. Bitbon System Personal Account
Article 4. Procedure for Creating the Bitbon System Personal Account
1. Bitbon System personal account (hereinafter referred to as the “personal account”) is a Bitbon System component[i] created as a result of the registration of an entity in the Bitbon System[i] in order to get the rights of the User[i].
2. When registering, the User shall create his/her Space ID and personal account password, as well as specify his/her contact information.
3. To confirm the authenticity of the information specified by the User to create a personal account, verification[i] is provided in the Bitbon System (hereinafter referred to as the “verification”).
4. The verification is carried out through certain actions of the verified User and/or through provision of supporting information about himself/herself as an individual or an organization to the Bitbon System Operator[i] (hereinafter referred to as the “Operator”).
5. During the registration of an entity in the Bitbon System, a Space ID is created.
6. A Space ID is an identifier created by the User to access and manage his/her personal account.
7. The User gains access to the functionalities of the personal account through the One Space[i] base service[i] the operation of which is regulated by the Appendix to the Bitbon System Public Contract One Space Base Service.
8. One User can have only one Space ID.
9. The User can register only one personal account. If passport and/or contact information provided by the User at any stage of the registration coincide with information that has already been assigned to another personal account, this User will be denied registration of a personal account.
10. In order to receive an appropriate ID Passport category, the User shall provide documents of proper quality verifying his/her identity and the place of registration and/or residence (for natural persons) or the place of registration and/or location (for legal entities).
11. Documents provided by the User shall meet the following requirements to be considered as “documents of proper quality”:
- Copies of the documents shall be in color, in high quality (maximum image clarity, without shading, black lines and other defects associated with the operation of scanning/photographing devices) and shall be correctly oriented (horizontally/vertically).
- Copies of the documents are accepted only in the following file formats: JPG, JPEG, PNG.
- The size of each file containing an electronic copy of a document shall not exceed 3 MB.
- It is not allowed to combine different types of documents into one file (e.g., copies of a passport and a utility bill shall be sent in separate files).
12. According to the Appendix to the Bitbon System Public Contract AML/KYC Policy, the Operator has the right to request the User to additionally provide certified hard copies of identity documents, as well as other documents required for verification.
13. Provision of a complete list of required documents by the User shall not guarantee the assignment of an appropriate category to an ID Passport of this User.
14. The Operator makes a decision to assign an appropriate category to an ID Passport of the User based on the information and documents provided by him/her.
15. The Operator has the right to take additional actions to identify the User by making an audio and/or video call using contact information specified by the User or by a personal meeting.
16. The information, as well as the electronic copies of documents provided by the User, shall be used for further identification of this User. Any discrepancy between the information provided by the User may lead to partial or full restriction of personal account access for this User.
Article 5. Elements of the Bitbon System Personal Account
1. The main personal account elements include: ID Passport, specialization card and account certificate.
Article 6. Procedure for Annulling the Bitbon System Personal Account Information
1. The Bitbon System[i] provides for annulling the personal account information on the initiative of the User[i].
2. The reason for annulling the personal account information on the initiative of the User is the corresponding request of the User to the Support Service of the One Space website.
3. The procedure for annulling the personal account information is carried out at the request of the User to the Support Service of the One Space website as follows: “Please annul my personal account information according to paragraph 3 of Article 6 of the Appendix to the Bitbon System Public Contract “Bitbon System Account”.
4. The Operator notifies the User about annulling his/her personal account information using contact information provided by him/her when registering this account 30 days before the annulling. The exception is cases where annulling may not be possible due to circumstances arising from legal, regulatory or governmental measures or circumstances related to the security and privacy of Users, technical integrity or continuous servicing of other Users, as well as cases related to natural disasters, cataclysms, military actions or other similar events that the Bitbon System is unable to influence.
5. The result of the annulling the personal account information is termination of the User’s access to the infrastructure of the Bitbon System[i], including, among other things, termination of access to this account and its information. In addition, after a certain period of time, the Operator shall delete information and data stored in the personal account or which shall be considered as its parts.
6. The Operator is not liable to the User or any third party for any losses that may result from annulling the personal account information.
Article 7. Suspension of Access to the Bitbon System Personal Account
1. The Bitbon System[i] provides for full or partial suspension of access to the personal account on the initiative of the Operator[i].
2. The Operator may at any time, under certain circumstances and without prior notice suspend access to the account in full or in part.
3. The grounds for full or partial suspension of access to the personal account include:
- 3.1. Violation of this Appendix and/or the Bitbon System Public Contract or other policies and regulations expressly stipulating the User’s liability and published on the official information resources of the Bitbon System[i].
- 3.2. Cases when the provision of the service to the User[i] is or may become illegal.
- 3.3. If illegal activity is detected in the User’s actions.
- 3.4. If the User has more than one registered personal account.
- 3.5. The User has not provided accurate, up-to-date and complete information to receive the appropriate category of ID Passport and/or Corporate ID Card.
4. The Operator suspends access to the personal account in full or in part. In the event the grounds for the full or partial suspension of access to the personal account are eliminated, the Operator resumes the access.
5. The result of full or partial suspension of access to the personal account is temporary termination of the User’s access to the Bitbon System infrastructure[i], including, among other things, temporary termination of access to the personal account and its information. In addition, after a certain period of time, the Operator shall delete information and data stored in the personal account or which shall be considered as its parts if this User does not eliminate the grounds for full or partial suspension of access to the personal account.
6. The Operator is not liable to the User or any third party for any losses that may result from full or partial suspension of access to the personal account.
Chapter 4. ID Passport
Article 8. ID Passport and Its Categories
1. The ID Passport is an element of the personal account based on information provided by the User[i] in order to be identified in the Bitbon System Social Network[i] as a natural person.
2. The ID Passport category is an indicator of the ID Passport that represents the existence of a certain set of verified account information of the User as a natural person.
3. The following ID Passport categories exist in the Bitbon System:
- category 1 — “Anonymous”;
- category 2 — “Beginner”;
- category 3 — “Formal”;
- category 4 — “Personal”;
- category 5 — “Verified” (subcategory А; В; С; D).
4. The amount of information provided by the User determines the ID Passport category. This information is confirmed in the Bitbon System through verification[i] in stages.
5. ID Passport categories are assigned automatically or as a result of validation and/or verification of information provided for approval of the request to receive the appropriate category and documents provided by the User.
6. Filling in the request form to receive the appropriate category by the User shall not guarantee the assignment of this category to the ID Passport.
Article 9. Procedure for Receiving the ID Passport
1. The User[i] automatically receives the ID Passport as a result of registration in the Bitbon System[i].
Article 10. “Anonymous” Category
1. The “Anonymous” category is a specialized category of the ID Passport and is assigned in order to restore full access to the personal account, including in case of loss of the Space ID and/or password.
2. The “Anonymous” category is implemented according to the Bitbon System Roadmap.
Article 11. “Beginner” Category
1. The “Beginner” category is automatically assigned to the ID Passport when registering the personal account.
Article 12. “Formal” Category
1. The “Formal” category is assigned to the ID Passport based on the request form, which the User fills in to receive this category.
2. To receive the “Formal” category, the User shall indicate in the request:
- full name;
- date of birth;
- gender;
- nationality;
- place of residence;
- current residence address;
- type, series, number, date and place of issue of the identity document.
3. The “Formal” category is assigned to the ID Passport as a result of validation of information provided for the approval of the request to receive this category and documents provided by the User.
Article 13. “Personal” Category
1. The “Personal” category is assigned to the ID Passport based on the request form, which the User fills in to receive this category.
2. To receive the “Personal” category, the User shall provide documents confirming information, which he/she provided when filling in the request form to receive the “Formal” category.
3. To receive the “Personal” category, the User shall provide:
- his/her identity documents (scanned copies or photocopies of proper quality of all pages of a valid passport or other identity document);
- documents confirming his/her place of residence issued no more than three months ago (scanned copies or photocopies of proper quality of a document certifying the place of residence, rental agreement, utility bills or other receipts for payment of services containing full registration address or current residence address).
4. The “Personal” category is assigned to the ID Passport as a result of verification[i] of information provided for the approval of the request to receive this category and documents provided by the User.
Article 14. “Verified” Category
1. The “Verified” category is assigned to the ID Passport based on the request form, which the User[i] fills in to receive this category.
2. To receive the “Verified” category, the User shall provide documents confirming information, which he/she provided when filling in the request form to receive the “Personal” category.
3. The “Verified” category is implemented according to the Bitbon System Roadmap.
Article 15. Subcategories of the “Verified” ID Passport Category
1. A subcategory of the “Verified” ID Passport category (hereinafter referred to as the “subcategory”) is an indicator of the “Verified” ID Passport category that represents the existence of a certain set of verified account information of the User as a natural person.
2. Subcategories are assigned by the Operator[i] as a result of validation and/or verification of information provided for the approval of the request to receive the appropriate subcategory and documents provided by the User.
3. Filling in the request form to receive the appropriate subcategory by the User shall not guarantee the assignment of this subcategory.
4. The rules for receiving a subcategory (assigning letter A; B; C; D) are as follows:
- 4.1. Subcategory D is assigned to the User having the “Verified” ID Passport category as a result of successful verification through an online meeting with an authorized representative of the Operator.
- 4.2. Subcategory C is assigned to the User having the “Verified” ID Passport category as a result of successful verification by providing legally certified documents of this User.
- 4.3. Subcategory B is automatically assigned to the User having the “Verified” ID Passport category as a result of two successful verifications required for subcategories C and D.
- 4.4. Subcategory A is assigned to the User having the “Verified” ID Passport category as a result of successful verification through a personal meeting with an authorized representative of the Operator.
Article 16. Terms and Conditions for Reducing and Restoring an ID Passport Category
1. In case of changing the information specified by the User to receive the appropriate ID Passport category, this category is reduced to the ID Passport category that corresponds to the changed information of the User.
2. The ID Passport category is restored in accordance with the terms and conditions for receiving the appropriate ID Passport category established by this Appendix.
Chapter 5. Bitbon System Corporate Account
Article 17. Bitbon System Corporate Account
1. Bitbon System corporate account (hereinafter referred to as the “corporate account”) is a Bitbon System component[i] allowing the User to represent the interests of a commercial or non-profit organization in the Bitbon System[i].
2. The corporate account contains a certain set of verified account information of the User as an authorized representative of a commercial or non-profit organization.
3. The User can create an unlimited number of corporate accounts using the functionalities of his/her personal account.
4. The Corporate ID Card categories is determined by the amount of information provided by the User as an authorized representative of a commercial or non-profit organization. This information is confirmed in the Bitbon System through verification[i] in stages.
5. The Corporate ID Card categories are assigned after verification of provided information for approval of the request to receive the appropriate category, as well as the documents provided by the User as an authorized representative of a commercial or non-profit organization.
Article 18. Corporate Account Registration
1. A mandatory requirement for the corporate account registration is that the User[i] as an authorized representative of a commercial or non-profit organization has the “Verified” ID Passport category of subcategory D and more.
2. The corporate account is registered using the functionalities of the User’s personal account by entering the data envisaged in the provisions of this Appendix.
Article 19. Corporate ID Card and Its Categories
1. The Corporate ID Card is an element of the corporate account based on information provided by the User as an authorized representative of a commercial or non-profit organization in order for this organization to be identified in the Bitbon System[i].
2. The Corporate ID Card category is an indicator of the Corporate ID Card that shows the existence of a certain set of verified account information provided by the User as an authorized representative of a commercial or non-profit organization.
3. The following Corporate ID Card categories exist in the Bitbon System:
- category 1 — “Commercial”;
- category 2 — “Non-profit”.
4. The Corporate ID Card category is determined by the information provided by the User as an authorized representative of a commercial or non-profit organization. This information is confirmed in the Bitbon System through verification[i] in stages.
5. The Corporate ID Card categories are assigned after verification of provided information for approval of the request to receive the appropriate category, as well as the documents provided by the User as an authorized representative of a commercial or non-profit organization.
6. The request to receive the appropriate Corporate ID Card category shall be submitted within 90 days from the date of the corporate account registration by the User as an authorized representative of a commercial or non-profit organization.
Article 20. “Commercial” Category
1. The “Commercial” category is assigned to the Corporate ID Card based on the request form, which the User as an authorized representative of a commercial or non-profit organization fills in to receive this category.
2. To receive the “Commercial” category, the User shall specify in the request form and/or provide:
- a registration certificate of the organization from the public register issued no more than three months ago;
- other documents stipulated by the requirements of the respective Regional Bitbon System Operator[i].
3. The “Commercial” category is assigned to the Corporate ID Card after verification[i] of provided information for approval of the request to receive this category and documents provided by the User.
Article 21. “Non-Profit” Category
1. The “Non-profit” category is assigned to the Corporate ID Card based on the request form, which the User as an authorized representative of a commercial or non-profit organization fills in to receive this category.
2. To receive the “Non-profit” category, the User shall specify in the request form and/or provide:
- a registration certificate of the organization from the public register issued no more than three months ago;
- other documents stipulated by the requirements of the respective Regional Bitbon System Operator[i].
3. The “Non-profit” category is assigned to the Corporate ID Card after verification[i] of provided information for approval of the request to receive this category and documents provided by the User.
Article 22. Procedure for Suspending the Corporate Account
1. The corporate account may be suspended in accordance with the User’s[i] request, which is based on the decision of the organization to suspend the corporate account.
Chapter 6. Specialization Card
Article 23. Concept of a Specialization Card
1. The specialization card is an element of the personal account based on information provided by the User about his/her knowledge and skills in a certain area that can be confirmed by Users having the appropriate role[i] in the Bitbon System.
Article 24. Procedure for Generating the Specialization Card
1. To generate the specialization card the User shall provide the following documents: diploma, certificate confirming his/her knowledge and skills in a certain area.
2. The procedure for generating the specialization card is implemented according to the Bitbon System Roadmap.
Article 25. Types of Specialization Cards
1. The Bitbon System provides for various types of specialization cards that are implemented according to the Bitbon System Roadmap.
Article 26. Procedure for Annulling the Specialization Card
1. The User[i] annuls the specialization card through the functionalities of the personal account.
Chapter 7. Account Certificate
Article 27. Concept of an Account Certificate
1. The account certificate is an element of the account generated automatically based on the verified account information of the User stored in the ID Passport or Corporate ID Card of various categories and specialization cards, as well as based on the status and role required to provide this User with access to certain functionalities of the Bitbon System infrastructure[i].
Article 28. Procedure for Generating the Account Certificate
1. In the Bitbon System[i] the account certificate is generated automatically based on:
- the verified account information of the User[i] stored in the ID Passport or Corporate ID Card of various categories and specialization cards;
- the status and role required to provide this User with access to certain functionalities of the Bitbon System infrastructure.
2. The procedure for generating the account certificate is implemented according to the Bitbon System Roadmap.
Article 29. Types of Account Certificates
1. The account certificates are characterized by certain types of the User[i] account certificates and account certificate indexes.
2. The types of account certificates are implemented according to the Bitbon System Roadmap.
Article 30. Concept of an Account Certificate Index and Procedure for Its Generating
1. The account certificate index is an indicator based on the level of use of the functionalities of the Bitbon System infrastructure[i] envisioned for a specific account certificate by the User.
2. The combination of account certificate indexes is considered when forming the account rating.
3. The procedure for generating the account certificate index is implemented according to the Bitbon System Roadmap.
Chapter 8. Account Rating
Article 31. Concept of an Account Rating
1. The account rating is an individual interval indicator of activity of the User formed by the Bitbon System Social Network[i] based on the algorithm established in this Appendix.
2. The account rating is a tool of the Bitbon System Social Network that motivates Users to use the functionalities of the Bitbon System infrastructure more actively and for various purposes.
Article 32. Principles of and Procedure for Forming the Account Rating
The algorithm of forming the account rating is implemented according to the Bitbon System Roadmap.
Chapter 9. Rights and Obligations of the Bitbon System User
Article 33. Rights of the Bitbon System User
1. The User[i] has the right:
- 1.1. To use the functionalities of the personal and/or corporate account in the manner and on the terms and conditions provided for by this Appendix and the Bitbon System Public Contract.
- 1.2. To initiate annulling his/her personal and/or corporate account information in the manner and on the terms and conditions provided for by this Appendix including if the Operator[i] makes significant changes to operation or the terms and conditions of the personal and/or corporate account use.
- 1.3. To provide information for approval of the request to receive the appropriate ID Passport and/or Corporate ID Card category.
- 1.4. To confirm his/her knowledge and skills in a certain area through verification and/or evaluation by other Users.
2. The User also has other rights provided for in and arising out of this Appendix and the Bitbon System Public Contract.
Article 34. Obligations of the Bitbon System User
1. The User[i] is obliged:
- 1.1. To use the personal and/or corporate account in compliance with the terms and conditions of this Appendix and the Bitbon System Public Contract.
- 1.2. To provide only up-to-date, accurate and complete personal data and information, as well as to update personal data if changes.
- 1.3. To ensure confidentiality of access to the personal and/or corporate account and prevent third parties from using the Bitbon System infrastructure[i] through his/her personal and/or corporate account.
- 1.4. Not to allow personal and/or corporate account authorization information (Space ID and password) to be stored in the browser, cached or recorded in any other way.
- 1.5. Not to use any features that allow storing the personal and/or corporate account authorization information and/or passwords on the device he/she uses.
- 1.6. Not to transfer the Space ID and/or personal and/or corporate account password to third parties.
- 1.7. To monitor any activities carried out through his/her personal and/or corporate account.
- 1.8. To immediately change his/her personal and/or corporate account login information if he/she suspects or detects signs of unauthorized access to his/her personal and/or corporate account.
- 1.9. To immediately (that is straight after the moment of detection) inform the Operator[i] about any suspicious changes and/or actions made through his/her personal and/or corporate account. In case of failure to inform or late notification of the Operator, the User shall be solely liable for the violation of this clause of this Appendix.
- 1.10. To use the functionalities of the personal and/or corporate account solely in his/her own interests and for achieving certain goals without violating rights of third parties and/or applicable laws.
- 1.11. To initiate annulling his/her personal and/or corporate account information if he/she does not accept this Appendix and/or the Bitbon System Public Contract in full or in any part.
2. The User also has other obligations provided for in and arising out of this Appendix and the Bitbon System Public Contract.
Article 35. Liability of the Bitbon System User
1. Every User[i] is fully and personally liable for disclosure of his/her personal and/or corporate account information.
2. Every User is fully and personally liable for maintaining the confidentiality and security of his/her personal and/or corporate account, as well as for all actions made in or through his/her personal and/or corporate account.
3. Every User is fully and personally liable for disclosing his/her personal and/or corporate account information to third parties.
4. Every User is fully and personally liable for any damage caused by the unauthorized use of the personal and/or corporate account due to the User’s failure to comply with security measures while creating and/or managing his/her personal and/or corporate account.
5. Every User is fully and personally liable for providing accurate and complete information when registering in the Bitbon System[i], as well as for timely updating his/her personal data and ensuring its accuracy and completeness.
6. The personal and/or corporate account is property of the Bitbon System, therefore it is not an object of inheritance.
7. Every User is fully and personally liable for submitting to the personal and/or corporate account any information or software, which are subject to the International Traffic in Arms Regulation and/or prohibited from export without prior written agency approval, including, but not limited to, certain types of software for encryption and source code without prior permission.
8. The User also has another liability provided for in and arising out of this Appendix and the Bitbon System Public Contract.
SECTION 3. CONCLUDING PROVISIONS
Chapter 10. General and Other Terms and Conditions
Article 36. General Terms and Conditions
1. Amendments and/or additions to this Appendix may be made solely under the rules provided for the Appendix to the Bitbon System Public Contract Making Amendments and/or Additions to the Bitbon System Public Contract.
2. If there is any discrepancy between various versions (printed, electronic, etc.) of this Appendix, its electronic version published on the official information resources of the Bitbon System[i] shall be deemed the official one.
3. This Appendix is translated into other languages only for convenience of Users[i]. In case of differences in understanding and/or interpretation of this Appendix, the Russian version shall prevail.
4. Only the Operators[i] are entitled to give an official explanation of this Appendix.
5. In accordance with Provision 2 of the Bitbon System Public Contract, this Appendix is an integral part of the Bitbon System Public Contract and comes into force after its publication on the official information resources of the Bitbon System.
6. In accordance with paragraph 3 of Provision 2 of the Bitbon System Public Contract, amendments and/or additions may be made to this Appendix only if such amendments and/or additions do not contradict the Provisions of the Bitbon System Public Contract and Appendices, which are an integral part of the Bitbon System Public Contract. Amendments and/or additions made to this Appendix shall be published on the official information resources of the Bitbon System and come into force in accordance with the Appendix to the Bitbon System Public Contract “Making Amendments and/or Additions to the Bitbon System Public Contract”.
Article 37. Other Terms and Conditions
1. The Operators strive to maintain uninterrupted operation of the personal and/or corporate account. By using the personal and/or corporate account, the User[i] agrees that there is a possibility of disruptions in the operation of the Bitbon System infrastructure[i], which may lead to a temporary interruption of the operation and limitation of access to the functionalities of the personal and/or corporate account in whole or in any part.
2. The User shall not use the personal and/or corporate account if he/she does not accept the rules, as well as the terms and conditions established by the Bitbon System Public Contract and/or this Appendix in whole or in any part.
3. When the User registers in the Bitbon System[i] and creates his/her personal and/or corporate account, he/she shall accept an offer from SIMCORD LLC on formation and development of the Bitbon System Social Network[i] and that shall mean the User’s acceptance of the rules, as well as the terms and conditions established by the Bitbon System Public Contract.
